User Agreement

Each participant utilizing Jackets Ticket Post agrees that their participation is at their own risk. Jackets Ticket Post is not for individual ticket brokering or scalping. The sale of individual game tickets is prohibited; persons violating this prohibition may be barred from utilizing Jackets Ticket Post at the sole discretion of the Columbus Blue Jackets.

The services are provided "as is" and "as available" without warranty of any kind, either expressed or implied or statutory.

The Columbus Blue Jackets (“Blue Jackets”); the affiliates, members, partners, employees and agents of the Blue Jackets; the National Hockey League, ("NHL"); and DigiKnow, Inc. (the “Website Services Provider”) (collectively, “the Entities”) make no representation or warranty that Jackets Ticket Post will meet your requirements, will always be available, accessible, uninterrupted, timely, accurate, secure or without error, delay or malfunction. The Entities specifically disclaim any and all warranties including, without limitation, (A) any warranties concerning the availability, accuracy, content or appropriateness of information or tickets made available through Jackets Ticket Post,(B) any warranties of any kind concerning any transaction that may be conducted on or through Jackets Ticket Post, (C) any warranties of title or warranties of merchantability or fitness for a particular purpose, (D) any violation of any state or federal privacy law or policy, and (E) any direct, indirect, incidental, special, consequential or punitive damages. As consideration for the provision of this service, users of Jackets Ticket Post agree they will not sue the Entities and will indemnify the Entities and hold them harmless for any suits arising from User’s participation in Jackets Ticket Post. The Entities may modify or discontinue Jackets Ticket Post and service, or any portion thereof, at any time with or without notice for any reason.
The Entities shall not be liable for any loss, damage or injury of any kind caused by, related to or arising from any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, infringing material, computer virus, communication line failure, theft or destruction or unauthorized access to, alteration of, or use of records or information, or uncompleted or completed transactions, statements or negligent or criminal conduct of any third party. Each participant agrees that the Entities are not liable for the acts or omissions (including, but not limited to, defamatory, offensive or illegal conduct) of other participants in Jackets Ticket Post or third parties and that the risk of the foregoing rests with each participant. Neither the Entities nor any of their affiliates, technical support partners and providers or content providers shall be liable for any direct, indirect, incidental, special, consequential or punitive damages arising out of the use of Jackets Ticket Post or its services.

USE AT YOUR OWN RISK.

ALL TERMS AND INTERACTIONS MUST BE SET UP INDIVIDUALLY AS THE ENTITIES ASSUME OESPONSIBILITY OR INVOLVEMENT IN THE TERMS YOU AGREE TO WITH OTHER PARTICIPANTS. WE RECOMMEND THAT ANY AGREEMENT YOU REACH WITH OTHERS THROUGH JACKETS TICKET POST  BE MADE IN WRITING.

NEITHER THE COLUMBUS BLUE JACKETS NOR NATIONWIDE ARENA WILL PROVIDE ANY ASSISTANCE, COMPENSATION OR RELIEF FOR FAILED TRANSACTIONS FACILITATED THROUGH JACKETS TICKET POST.

THIS AGREEMENT IS GOVERNED BY OHIO LAW. USER AGREES TO THE JURISDICTION OF THE FRANKLIN COUNTY, OHIO COMMON PLEAS COURTS AS A TERM AND CONDITION OF UTILIZING THIS SERVICE.
